Resumen
La Asociación Europea de Libre Comercio (EFTA) y el Mercado Común del Sur (MERCOSUR) firmaron el Tratado de Libre Comercio (TLC) en septiembre 2025, después de 8 años de negociaciones. Durante estos años han surgido preocupaciones sobre los posibles impactos ambientales que trae este TLC. Este artículo analiza el Capítulo 13 “Comercio y desarrollo sostenible” del Tratado de Libre Comercio (TLC) entre EFTA y MERCOSUR a través del análisis de documento y la teoría de normas obligatorias y normas no vinculantes. El análisis revela que, aunque el texto es amplio en sus compromisos con respecto a la sostenibilidad, la falta de delegación y obligatoriedad hace que el Capítulo sea declarativo y aspiracional. El TLC es una oportunidad perdida de mejorar las prácticas de sostenibilidad en el comercio internacional.
