Resumen

Este artículo tiene como objetivo analizar las implicaciones del big data en el campo de las fusiones y adquisiciones y el derecho de la competencia, desde una perspectiva crítica y comparada. En primer lugar, realiza una breve introducción al tema, a partir de la consulta de textos que logran situar el desarrollo del paradigma jurídico actual. También estudia el desempeño teórico de la política antimonopolio en medio de la era digital. Por lo tanto, trae un análisis comparativo de casos emblemáticos de fusiones y adquisiciones desde la perspectiva de tres diferentes autoridades antimonopolio (brasileña, estadounidense y europea), esenciales para la situación del panorama legal en el ámbito internacional. En consecuencia, concluye que la jurisprudencia transita hacia una acción cooperativa entre los institutos, dentro de sus respectivas competencias.
